PLACING AN ORDER

+ How do I place an order on the Bally website?
Placing an order is quick and easy:
  • Browse through our product categories and click on the images to access the individual product page where you will be offered information on the size and material.
  • Select your item and add to your shopping bag by clicking on the ‘ADD TO BAG’ button.
  • You are able to review the items you have chosen by clicking on the ‘BAG’ icon at the top right hand corner of the website. To delete any items from your shopping bag, you can simply click on the 'REMOVE' button next to the item.
  • To resume shopping after viewing your shopping bag, click the ‘CONTINUE SHOPPING’.
  • To finalise your purchase, click ‘CHECKOUT’ and follow the instructions.
  • Please be aware that items in your bag are not reserved and may still be purchased by other customers, until you checkout.
+ Do I need to create an account to place an order?
You are not obliged to create an account to make a purchase, you may also checkout as a guest. Bally recommend that you create an account to enjoy the full benefits of managing your account, including stating your contact preferences, store payment cards and address details.

+ How will I know when you have received my order?
After you place your order, you will receive an email confirming your order. Please note that this does not constitute an acceptance of your order, as payment has not yet been taken. You will also receive an Order Confirmation once all your details have been checked and the availability of your order has been verified. The contract between you and Bally will be effective from the moment your order has been dispatched.
+ Do you offer a Gift wrapping service?
Gifting services are available to select in your Shopping Bag before Check Out and are complimentary of Bally. Selecting the Gift service gives the option to remove the price from any packaging and paperwork and add a personal touch with a special message, printed and included inside the box.
+ Can I order corporate gifts on your website?

PAYMENTS

+ What payment types does Bally accept?
Bally accepts Visa, Visa Debit, AMEX, AMEX Debit, MasterCard, MasterCard Debit and PayPal online. Please note that additional payment authentication may be required by your card issuer such as Verified by Visa, MasterCard Secure Code and AMEX SafeKey.
+ When will Bally debit my card/account?
At the point of order your financial institution may authorise the required funds. Bally, however, will not request the funds until your order is dispatched.
+ Is it safe to use my credit/debit card on your website?
Security of your personal details is very important to Bally. To ensure your shopping experience is safe and secure, Bally uses Secure Socket Layer (SSL) technology to protect the data sent to us over the internet. All payment transactions on the site are processed via Cybersource Corporation, a secure online payment gateway which encrypts your payment details in a secure host environment.

+ Can I claim a tax refund on purchases made online?
At this time we are unable to provide a tax-back (tax refund) service for any of our online customers.
+ When will I be charged for my order?
Your card or other method of payment will not be charged until your order is dispatched. However, your bank balance may reflect deduction of funds immediately upon order.
+ Why is my order not being accepted?
Please be sure that the address entered in the "Billing" field is the address that is registered with your bank. DELIVERY

+ How long will it take for me to get my order?
Bally Australia offers free next business day delivery - we aim to deliver all orders the very next day. This is our standard delivery service. There will be some regional areas across Australia that will be excluded from next day delivery; however we will still aim to make delivery to these areas within 3 business days. If you have further questions about this please contact Customer Service and we can advise you on the progress of your order.

Your parcel is covered / insured during transportation to your delivery address. Bally is not liable, nor is the delivery company if an order is left without a signature on permission from the receiver.
+ Can I change my delivery address once my order has been dispatched?
Unfortunately, we are unable to change your delivery address after your order has been placed.
+ Can I track my order?
Yes – you can track though your account on the website.
+ Can I collect my order in store?
You can now shop online at bally.com.au and collect your order in selected stores. You will be notified via email as soon as your order is available for in store collection

RETURNS

+ How much is the returns charge?
For all orders, returns are free of charge unless otherwise specified in the General Terms and Conditions of Sale. You must follow our returns process to ensure your return is managed safely and securely.
+ How do I return an item?
Returns are made simple & free! Simply contact our Customer Service team to arrange a return or drop off at your local store.
+ Can I return a shoe care product?
Currently Bally cannot accept returns for shoe care products.
+ Can I return a faulty item?
You have the right to return items with defects or quality problems.
Should you find that your items have any manufacturing defects or quality problems, you should immediately Email Bally Customer Service at CustomerServiceAUS@bally.ch or call us on 1800 78 1851.
Bally Customer Service will provide you with full instructions to return your goods.
Upon receipt, we will carefully examine your items and if any damages or defects are identified, we will repair or replace them free of charge. If we are unable to repair or replace your item, we will offer you a full refund.
Please note: If your items are not deemed faulty, damaged, do not have any quality issues or have been damaged due to misuse, you will not be entitled to repairs/replacements or refunds and Bally will return the items back to you, at your expense and liability.
+ Will I receive a full refund?
All items are rigorously quality checked. Once your goods are deemed to be in perfect condition, new, unused and with all tags and labels attached, Bally will credit your card/payment method with the price originally paid. Bally is only able to refund the card/payment method originally used for the purchase.
+ When will I receive my refund?
All items are rigorously quality checked. Once your goods are deemed to be in perfect condition, new, unused and with all tags and labels attached, Bally will credit your card/payment method with the price originally paid.
Bally will credit your card/payment method originally used as soon as your items have been checked. We will send you an Email confirmation once your refund has been issued.
Please note: Bally is only able to refund the card/payment method originally used for the purchase and it may take up to 10 days, from the date of refund, to appear on your statement/in your account – dependent on your card/payment issuer.
+ Can I return my order in store?
Yes, orders placed online can be returned to a store of your choice (excluding outlet and airport stores). Please note we can only accept store returns within the same country of delivery. From the day of recepit, you will have fourteen (14) days to submit a returns request. All returned merchandise must be in a new and unused condition with all tags and labels still attached. Bally will issue a credit for the amount originally paid. Bally can only issue a refund to the original form of payment. + Can I exchange an item bought online?

+ What is the difference between an adjustable belt and a fixed belt?
Bally has two types of belt constructions – adjustable and fixed. If your belt is fixed, it has been designed with multiple size options to choose from. If your belt is adjustable, it has been designed with a singular length of material. The buckle can be removed and the material can be cut in order to fit you perfectly. Returns Policy

Returns Policy

1.1 As a consumer, you may cancel your contract in relation to Products purchased on the Website, without any penalty, by contacting CustomerServiceAUS@bally.ch or call 1800 78 1851. You can submit your return request via email by using this Model withdrawal form. If you use the Model withdrawal form we will e-mail you to confirm we have received your cancellation. You have fourteen (14) days from delivery of the Products to submit your returns request.

1.2 Only return shipments using our approved courier will be free of charge and at Bally's cost and liability.

1.3 Should you decide to use a courier other than the Bally approved courier, you will bear all associated costs and liability. Any costs or expenses incurred by you in the return of Products are not refundable.

1.4 You shall return the Products within 7 (seven) working days from the date you receive the return authorisation number from Bally.

1.5 You shall return the Products by packaging the relevant Product(s) securely. You shall return the Product(s) in the same condition in which you received them and they shall be returned in their original packaging; moreover, the Products shall not have been washed or damaged and the relevant identification tag(s) shall still be attached to the Products with the disposable seal. Please note that Bally will review the returned Product(s) via quality control. If the Product(s), are received in perfect condition, new and with all tags and labels attached, Bally will approve the return and reimburse the price originally paid. If the recipient of the Product(s) indicated in the order form is different from the individual who made the payment for such Product(s), the amount paid for returned items shall be refunded to the individual who made the payment.

1.6 If any of the labelling or tags are missing, do not comply with these General terms and Conditions of Sale or Bally has any reason to believe that the Products have been altered, used or are imitation of the Products or were not purchased directly through this Website, Bally will not accept the return and will return the Product(s) back to you.

1.7 Should Bally accept the return, we shall refund the price of the Product(s). Bally will refund to the card/payment method you originally used to pay for the Products, within fourteen (14) days from the date on which you give notice of your withdrawal, unless possible delays of a technical nature occur that are not attributable to Bally. Should you decide to use a courier other than the Bally approved courier, we may withhold the reimbursement until we have received the Product(s) back, or until you have supplied evidence of having sent back the Product(s), whichever is the earliest.

1.8 You may also return the Products to stores owned or directly operated by Bally within the same country of delivery. This returns policy does not apply to purchases bought in franchising shops, outlets, retail stores, department stores, duty free shops or any other website.

1.9 Because you are a consumer, we are under a legal duty to supply Products that are in conformity with our contract with you. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in these T&Cs. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

1. OUR BUSINESS POLICY

1.1 Bally offers the Products for sale on its Website, including its e-commerce business services exclusively to its end users i.e. any natural person who is acting for purposes which are outside his/her trade, business or profession (a "consumer"). If you are not a consumer, please do not buy any Product(s) on the Website. We reserve the right not to process orders received from users who are not consumers and any other order which does not comply with our business policy.

1.2 Bally only offers its Products to consumers over the age of 18. If you are under 18 you are strictly prohibited from ordering Products from the Website. Bally reserves the right to cancel any orders from consumers we believe to be under the age of 18.

1.3 We do not sell second-hand Products, flawed Products or Products of lower quality than the corresponding market standards. The main characteristics of Products are shown on the Website and on each Product page. The Products offered for sale on the Website may not exactly correspond to the real Products in terms of image, dimensions and colours depending on your Internet browser or monitor quality.

2. HOW TO PROCESS AN ORDER

2.1 To place an order you should select the Products you desire to purchase on the Website, select a size, add the items to your shopping bag by clicking on "Add to Shopping Bag". Once you are ready to checkout, click on the shopping bag icon at the top right of the screen which will display all of the Products you have selected to purchase. It is your responsibility to check the items in your shopping bag are the correct style, colour and size before proceeding. Once you are ready to proceed with your order, click on "Secure Checkout" where you will be able to add gifting options and will be asked to select your preferred payment method and delivery option as well as enter personally identifiable information and after having read and accepted these T&Cs, click on the relevant acceptance button. You will be requested to log into your personal account (if you are already registered) or continue through guest check out.

2.2 All orders are subject to acceptance and availability. Please be aware that Products in your Shopping Bag are not reserved and can therefore be purchased by other users until you complete the whole checkout process.

2.3 Your order is an offer to Bally to buy the Product(s) contained within your order and is binding for a period of 15 (fifteen days). An order shall be deemed to have been submitted to Bally when you receive an order receipt email (automatically generated) confirming the content of your order which has been received and is being assessed.

2.4 This order receipt email is a mere acknowledgement that we have received your order, but it does not confirm our acceptance of your offer to buy the Products.

2.5 Your offer shall be deemed as accepted and the relevant contract of sale is effective from the moment Bally dispatches the Product and you receive a confirmation email containing information about the acceptance of your offer, the dispatch time, essential characteristics of the purchased Products, a detailed breakdown of the price paid for each Product and delivery costs and details ("Order Status Update").

2.6 If your order is dispatched in more than one package, you may receive separate email for each package and by means of each separate order we conclude a separate contract of sale for the Product(s) specified in these emails.

2.8 Bally reserves the right not to accept your order at its own discretion. In such case, Bally will inform you by email of the cancellation of the order.

3.PRICES AND PAYMENTS

3.1 All prices indicated on each Product page are inclusive of applicable taxes. Prices are subject to change. However, such changes will not impact the price, or the description of the Products which you have already submitted an order for.

3.2 Although we have taken all reasonable care that prices contained in the Website are accurate at the time of publication, a small number of Products in our Website may be mispriced. Prices are confirmed when you will receive your order receipt email outlining the different charges (including delivery).

3.4 We take reasonable care to make our Website secure. All credit/debit card transactions on our Website are processed using Cybersource, a secure online payment gateway that encrypts your card details in a secure host environment. We will securely store your credit/debit card details on the Demandware platform. These details will be fully encrypted and only used to process card transactions which you have initiated or to issue refund in case of return or unavailability of the Products or for reporting cases of fraud to the police.

3.5 Should your payment fail to process the order online, please ensure that all your details submitted are correct and retry the transaction. Should the problem persist, please contact your card issuer directly as Bally will be unable to assist you with these types of payment failures.

3.6 Payment will be "reserved" or "frozen" by your card issuer when you attempt to/make a purchase on the Website. The price for the purchase of Products and the corresponding costs for shipping and delivery, as indicated in the order receipt email, will be charged to your chosen payment method only when the purchased Products are actually shipped.

3.7 To ensure that your credit or debit card is not being used without your consent Bally will validate your name, address details and other personal information supplied by you in placing the order through facilities offered by Cybersource Corporation.

3.8 Bally reserves the right to implement any additional and/or other payment security system from time to time.

3.9 Refunds, for whatever cause due, of any payment received by you will take place using the same method of payment you chose during the check-out procedure and cannot be amended after your order has been placed. Bally will not be responsible for any delays beyond its control including delays caused by the method of payment/refund or those incurred by the card issuer.

4. SHIPPING AND DELIVERY

4.1 For specific shipping and delivery details, the information provided in the below section forms an integral part of the Ts&Cs and is hereby incorporated by reference.

4.2 Delivery from this Website is restricted to the Country only.

4.3 Bally are unable to deliver to addresses such as P.O boxes or BFPO. Any orders with these delivery details will be automatically cancelled.

4.4 The Order Status will contain information on the carrier and the associated tracking number(s).

4.5 Currently, the Bally carriers are only able to deliver Monday to Friday (excluding public holidays), during working hours in the Country.

4.6 We will make every effort to deliver the Products by the estimated delivery date indicated in your order form and during your checkout. However, such delivery date is not binding and Bally will not be liable for any delay in delivery.

4.7 In the event that we are unable to deliver the Products to you within 30 days from the conclusion of the contract, you are entitled to terminate the contract and to request the full reimbursement of your order.

4.8 All shipments will require a legible signature of the customer upon delivery.

4.9 Upon delivery, it is your responsibility to ensure that the parcel being signed for is without damage, visible alteration or wet. Any such defects should be reported on the delivery note (when you sign for the delivery).

4.10 Upon full and correct payment, delivery, and signature of the parcel, the Products will become your property and you will become fully responsible for the Products.

4.11 If you order Products from our Website for delivery to one of the international delivery destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount. You will be responsible for payment of any such import duties and taxes. 5. RIGHT OF WITHDRAWAL/RETURNS POLICY

5.1 As a consumer, you may cancel your contract in relation to Products purchased on the Website, without any penalty, by either contacting Customer Service on 1800 78 1851, Email: CustomerServiceAUS@bally.ch or you can submit your return request via email by using the Model withdrawal form. You have fourteen (14) days from delivery of the Products to submit your returns request.

6. WARRANTY

6.1 Bally warrants to the consumer that the Products that we deliver from this Website comply with the specifications and are free of material defects and workmanship errors for a period of twelve (12) months from the date of delivery.

6.2 Details of the statutory warranty on consumer goods, terms and conditions and explanations of how to exercise the relevant rights and returning the defective Products are provided in the Warranty Policy.

8. LIMITATION OF LIABILITY

8.2 We do not in any way exclude or limit our liability for:

(a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation;

(c) any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);

(d) any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and

(e) defective products under the Consumer Protection Act 1987.

8.3 Except for cases of gross negligence and fraud, in no event will Bally and/or its affiliate be liable to the buyer for lost profit or any damages of any nature arising out or related to these T&CS and/or in connection with third party claims raised against the purchaser of the Product.

8.3 If we fail to comply with these T&Cs, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.

8.4 We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

8.5 Although we have taken all reasonable care that the information contained within the Website is accurate at the time of publication, no representation or promise (including liability towards third parties), expressed or implied, is made as to its accuracy or completeness or fitness for any purpose by us or our group companies.

8.5 The total amount of Bally's liability in respect of the purchase of Products under these T&Cs is limited to the amount paid by the buyer for the purchase of the Products.

8.6 Liability based on statutory provisions protecting consumers shall remain unaffected.

10. ASSIGNMENT

10.1 Bally may sub-contract the performance of all or any of its obligations under these T&Cs at any time without the consent and may transfer these T&CS (including a transfer resulting from a merger, demerger, division, transfer of a business unit or part of a business unit or the entire business) and/or the purchase contract entered into by and between Bally and the buyer, completely or partially, to third parties (including affiliates of Bally), without your consent , but this will not affect your rights or our obligations under these T&Cs.

10.2 The Customer must not assign or subcontract any right or obligation under these T&Cs without the prior written consent of Bally.

11. FORCE MAJEURE

11.1 In the event of strikes, difficulties or other events due to general or local extraordinary conditions, which would influence the delivery of the Products, Bally shall be authorised to postpone deliveries or to cancel them.

11.2 We will not be liable for any failure, any suspension or any termination of access to the Website arising out of any event beyond our reasonable control.

In addition, your personal data may be processed by third parties belonging to the following categories:
a) third parties that provide services for the management of the IT system;

c) law enforcement or regulatory agencies, or other authorized third-parties.

7. HOW LONG ARE PERSONAL DATA RETAINED?

Your personal data will be processed and stored for as long as required for the purposes for which they were collected, and in accordance with the storage periods provided for by the applicable laws, or until you revoke your consent to the processing, if applicable. After such period, your personal data will be automatically and permanently erased or made anonymous.

For example, should you register to the Website, your personal data will be deleted following your departure (i.e., “deregistration” from the Website), as long as no purchase is performed through the Website and no issues regarding the services we have provided to you are pending at the time of your leaving.

Warranty Policy

1.1 Bally warrants to the consumer that the Products comply with the specifications and are free of material defects and workmanship errors for a period of twelve (12) months from the date of delivery.

1.2 This warranty applies only to Products which are a) manufactured by or for Bally as identified by the "Bally" trademarks, trade name, or logo legally affixed to them and b) purchased by consumers from this Website.

1.3 If a Product has manufacturing defects or in any case of alleged lack of conformity of Products, in order to benefit from his/her rights under this warranty policy the customer must notify the Customer Service on 1800 78 1851, Email: CustomerServiceAUS@bally.ch within a period of two months from the date on which he/she detected such lack of conformity. In any case, the proceedings intended to enforce the lack of conformity not fraudulently hidden by Bally shall in any event expiry after twenty-six months from delivery of the Product(s).

1.4 The Product(s) should be returned to Bally within 15 (fifteen) working days following notification to Bally of the damaged or defective Products.

1.5 Bally will examine all Products returned as damaged or defective and in case of a lack of conformity, will replace the Product, or, if this is not possible, refund the price paid.

1.6 Bally will refund the price and your costs of returning defective Products using the same method originally used by you to pay for the purchase. If the recipient of the Products indicated in the order form is different from the individual who made the payment for such Products, the amount paid for returned items shall be refunded by the Vendor to the individual who made the payment.

1.7 In the event that Bally finds no fault with the returned Products, you will be notified on the above and that the returned Products cannot be accepted and you may elect to have the Products re-delivered to you. If you do not accept re-delivery, Bally reserves the right to retain the Products and the purchase price.

1.8 This warranty does not apply (i) if the Product has been subject to faulty and improper use, repair, alteration and/or modification in any way that is not covered in the documentation for the Product; (ii) to damages caused by failure to follow the instructions covered in the documentation for the Products or other specific instructions from Bally; (iii) if the Product is damaged by misuse, abuse, negligence, accident, normal wear and tear and deterioration, improper environmental conditions or lack of responsible care, (iv) to damages due to any other cause not related to defective design, workmanship and/or materials.

1.9 This warranty is in addition to your legal rights in relation to Products that are faulty or not as described.
